Terms & Conditions

Welcome to MK Creative Base! These Terms and Conditions ("Terms") govern your use of our creative assets, including but not limited to 3D assets, 2D assets, General Designs, Video production, and other media and creative materials ("Assets"). By purchasing, downloading, or using any of our Assets, you agree to abide by these Terms. If you do not agree, do not use our Assets.

1. License Grant

1.1. Upon purchase, you are granted a non-exclusive, non-transferable, revocable license to use the Assets for personal use only.

1.2. This license does not grant you ownership of the Assets. All rights remain with MK Fox Designs, MK Peacemaker Productions & MK Creative Base in its totality.

1.3. No commercial use is permitted. The Assets may not be used in any commercial projects, whether directly or indirectly (more information in section 6).

2. Prohibited Uses

2.1. Resale & Redistribution: You may not resell, distribute, share, sublicense, or otherwise make the Assets available to third parties in any form, whether for free or for profit.

2.2. Claiming as Own: You may not claim authorship or ownership of the Assets.

2.3. Modification & Derivatives: You may modify the Assets for personal use, but the modified Assets cannot be resold, distributed, or shared.

2.4. Incorporation into Competing Products: You may not use the Assets in a way that directly competes with MK Fox Designs, MK Peacemaker Productions & MK Creative Base in its totality, such as in asset packs, templates, or any similar products.

2.5. Gifting or Free Sharing: You may not share, gift, or distribute the Assets, even if you obtained them legally.

2.6. Unauthorized AI Use: You may not use the Assets for training AI models, machine learning, or similar automated generation tools.

2.7. Illegal, Harmful, or Offensive Use: The Assets may not be used in any illegal, harmful, offensive, defamatory, or unethical manner.

3. Special Terms for RDR2, Keymaster, and CitizenFX Assets

3.1. The Assets designed for RDR2, Keymaster, and CitizenFX are strictly intended for RDR2 asset streaming and may not be used for any other purpose.

3.2. You may not modify, rip, extract, reverse-engineer, or alter the Assets beyond what is necessary for RDR2 asset streaming.

3.3. Redistribution, resale, gifting, or sharing of these Assets is strictly prohibited.

3.4. Any unauthorized use of these Assets outside of RDR2 asset streaming will result in immediate revocation of the license and possible legal action.

4. Copyright and Ownership

4.1. All Assets remain the intellectual property of MK Fox Designs, MK Peacemaker Productions & MK Creative Base in its totality or their respective creators.

4.2. Unauthorized use, reproduction, or distribution of the Assets constitutes copyright infringement and may result in legal consequences.

5. Exclusivity Rights

5.1 Exclusive Commission
If the customer desires an exclusive commission, meaning the seller (MK Fox Designs, MK Peacemaker Productions, and MK Creative Base in its entirety) is prohibited from reselling the specific asset or any "texture changed" variants thereof, the customer must explicitly request this on the purchase ticket. Exclusivity will only be honored if agreed upon in advance and will be reflected in the agreed-upon price.

5.2 Non-Exclusive Commission
If the customer agrees to a non-exclusive commission, the seller retains the right to resell the asset or any variants of it at their discretion after 30 days of the purchase. As a result, the customer may receive a reduced price for the non-exclusive nature of the commission, as the seller is allowed to market and resell the asset to others.

5.3 Waiver of 30-Day Rule
The 30-day resell rule can be waived if the customer allows the seller to resell the asset earlier. If the customer offers this waiver, they have the right to request 10% of the package's earnings during the waived 30-day period, equivalent to the original rule

6. Commercial Use

6.1 If the customer intends to use the asset for commercial purposes, an additional charge will apply. The exact fee for commercial use will be determined and agreed upon by both parties and specified in the purchase ticket. 

6.2 The customer is not permitted to use the asset commercially unless the additional commercial use fee has been paid in full.

7. Refunds and Support

7.1. Due to the nature of digital products, all sales are final, and refunds will not be provided.

7.2. If you encounter issues with an Asset, please contact our support team at customer_support@mkcreativebase.com or join our discord https://discord.gg/DZRe88tJCP within 14 days of purchase for guaranteed assistance.

8. Termination and Enforcement

8.1. Violation of any of these Terms automatically terminates your license to use the Assets.

8.2. MK Fox Designs, MK Peacemaker Productions & MK Creative Base in its totality reserves the right to take legal action against anyone who violates these Terms.

9. Changes to These Terms

9.1. We reserve the right to update these Terms at any time without prior notice.

9.2. Continued use of the Assets after changes to these Terms constitutes acceptance of the revised Terms.

- By purchasing the product you agree to NOT share the files with anyone who has not also purchased the product.

- You are allowed to commission/take commissions for putting the package on an avatar (as long as both parties bought the product).

- You are allowed to modify or repaint the texture files

- You are NOT allowed to modify, change or move the files with commercial intentions and resell or gift them as your own.

- You can´t claim the product as your own

- You are allowed to make public avatars with the package contents, but not directly share the files.

- I am not responsible for you breaking your avatar if you import the package content wrong, it is advised you take a backup of your avatar before attempting to install it.

- The package is for PERSONAL USE ONLY. you cannot use it commercially.

Any violation of these terms will result in the withdrawal of your license, a broken contract report to the platforms where the package is being used or is intended to be used (VRChat Inc, CitizenFX, Valve Corporation, Rockstar Games...) with the removal of your account as a result, a broken contract report to Sahil Lavingia (Gumroad), Overwolf Ltd (Tebex) and Copyright Agency (CA) with the removal of your account, and possible legal action against you or your legal guardian as a result.

THE CONTENTS OF THE PACKAGE ARE FOR REDM PROP STREAMING ONLY

No model, commercial license, or creative license is being sold with the package.
All the materials in the package (YMAP, XML, YTD, YDR, YTYP...) created by MIKOTICO or any other member of MK Fox Designs are protected by Copyright© laws and GitHub protection.

Resource Visibility Requirement

By purchasing and using one our RDR2 or GTA packages, the customer agrees that if the package is added to a server’s resource or content folder, it must be properly loaded and appear publicly in the server’s resource, asset, or content list as visible to users or administrators. This ensures proper attribution and functionality.

The purchase of the package doesn't give you the right to modify, sell, or claim its contents as your own. Failure to meet any of these terms and conditions may result in a permanent ban from our services, a withdrawal of package licenses from the store, a ban in both Discord and Tebex and an official report to CitizenFX.
